Terms of Service

These terms are an agreement between you and Malega Ventures LLC ("we", "us"), the maker of Toon Royale (the "game"), on the website toonroyale.com and in the iPhone and Android apps. By playing you agree to them and to our Privacy Policy. If you don't agree, please don't play.

1. Who can play

The game is not directed at children under 13. If you are under 13, please don't play or use crew chat. If you are under the age of majority where you live, you may only play, and only buy things, with the permission of a parent or guardian, who accepts these terms for you.

2. Your account

• The game makes an anonymous account on your device. If you lose the device or clear its data without signing in (Apple, Google or email, optional), we may not be able to recover your account.
• Keep your sign-in safe. You are responsible for what happens on your account.
• Don't sell, buy, share or transfer accounts, and don't use more than one account to gain an advantage.
• Pick a display name that follows the conduct rules below; we may change names that don't.

3. Virtual currency and items

• Tokens, Bucks, Lunchboxes, cards, characters, champions, emotes, skins, the Toon Pass and anything else you get in the game ("virtual items") are a limited, personal, revocable licence to use them in the game. You don't own them.
• Virtual items have no cash value, can't be exchanged for real money or anything of value, and can't be transferred outside the game.
• Lunchbox contents are random; the odds are shown in the game before you open or buy one.
• We may change, rebalance or remove virtual items and game features (for example to fix bugs or keep the game fair). Items gained through bugs, exploits or cheating may be removed.
• Refunds: purchases in the iPhone app are handled by Apple and in the Android app by Google, under their refund rules; please ask them. Purchases on the website are handled by Stripe; contact [email protected] and we follow the law that applies to you. Unless the law says otherwise, purchases are final once the items are delivered to your account.

4. Play fair (acceptable use)

You agree not to:

• cheat, or use hacks, modified game files, bots, scripts, macros or any tool that plays for you or changes how the game works;
• exploit bugs or glitches instead of reporting them to us;
• tamper with match results, saves, purchases or our servers, or try to get into other players' accounts;
• overload, attack, scrape or reverse-engineer the servers, or get around our limits or security;
• use the game for anything illegal, or to make money (for example selling items, accounts or boosting) without our written permission.

The servers check match results. Results that don't add up earn nothing, and accounts that cheat may be reset, suspended or banned, without refund of purchases where the law allows.

5. Crew chat conduct

• Be respectful. No bullying, harassment, threats, hate speech, sexual content, spam or scams.
• Never share personal information (yours or anyone's): real names, addresses, phone numbers, social media, school.
• Use Report and Block in the game when someone breaks these rules. We may remove messages, mute players and close crews.
• You are responsible for what you write. By posting, you allow us to show your messages in the game and to keep them as described in the Privacy Policy.

6. Ending your account

You can stop playing and delete your account at any time (Settings > Delete Account, or by email). We may suspend or close an account that breaks these terms, harms other players or the game, or as required by law. We may also change, pause or end the game or any part of it; if we shut the game down for good, we will try to give notice in the game first. When an account or the game ends, your licence to its virtual items ends too.

7. Our game

The game, its characters, art, music, code and everything else in it belong to Malega Ventures LLC or its licensors. We give you a personal, non-exclusive, non-transferable, revocable licence to play it for fun, under these terms.

8. App stores

If you play the iPhone or Android app, Apple's or Google's store terms apply too. These terms are between you and us, not Apple or Google; they are not responsible for the game or its support. Apple and its subsidiaries are third-party beneficiaries of these terms for the iPhone app and may enforce them.

9. Disclaimers

The game is provided "as is" and "as available". To the extent the law allows, we make no promises that it will always be available, error-free, secure, or that your progress or virtual items can never be lost, and we disclaim all implied warranties (such as merchantability, fitness for a particular purpose and non-infringement). Some places don't allow these exclusions, so some may not apply to you.

10. Limitation of liability

To the extent the law allows, Malega Ventures LLC is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, lost virtual items or lost profits, arising from the game or these terms. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim, or US$50. Nothing here limits liability that can't be limited by law.

11. Governing law and disputes

These terms are governed by the laws of the State of [STATE], United States, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in [STATE], unless the law where you live gives you the right to bring it elsewhere. Before going to court, please email us so we can try to fix the problem.

12. Changes to these terms

We may update these terms from time to time. We will post the new version here with a new effective date, and tell you in the game if a change is important. If you keep playing after a change takes effect, you accept the new terms.
